THE HUMANNATION STUDIOS 2009 SPOTLIGHT MARKETING CONTRACT SEARCH OFFICIAL RULES
1. Eligibility:
Contest open to Dancers, Models, Actors, Musicians/Bands, Fashion Designers, Make-Up & Hair Stylists, Photographers, Filmmakers, Writers/Poets, Entrepreneurs, Athletes, Skaters, Bikers, Community organizers and Grass Roots organizations who are legal residents of the Southern California. Applicants must be at least 16 years old at the time of entry. Applicants under 18 years of age are required to have written consent from a legal guardian and must be accompanied at the casting call appointment date with their legal guardian.
Employees, officers, directors and representatives of HumanNation Studios, LLC, 410 Grand Cypress Ave. Suite # 203, Palmdale, CA 93551 (“Sponsor”), family members, (spouse, parents, siblings, children and their spouses) and persons living in the same households of each of the above are ineligible to enter or win. All federal, state and local laws, rules and regulations apply.
2. How to enter. (Photo Session Included):
Contest entry period begins on 07/20/09 and ends on 09/05/09. You may enter the Contest via our online website or in-studio at our HumanNation Studios office. Eligible Entry To enter, (1) fully complete an official Contest entry form available online @ www.humannationstudios.com or at our in-studio location (IF ENTRANT IS UNDER 18 YEARS OF AGE ENTRY FORM MUST BE SIGNED BY ENTRANT’S PARENT OR LEGAL GUARDIAN GIVING ENTRANT PERMISSION TO ENTER THE CONTEST); (2) A Live 1-2 minute recording of live performances/auditions and/or pitches from contestants; all entrants are required to submit a pitch, audition or performance of their trade/skill and/or passion for demonstration & scoring.
All required information on an entry form and other submitted information must be provided in English to be eligible. Sponsor reserves the right, in its sole discretion, to disqualify any entry, which Sponsor believes, in its sole discretion, may be defamatory, obscene, profane, offensive, harassing, and inappropriate or that may infringe upon or violate another party’s rights. All entry materials become the property of Sponsor and will not be returned unless otherwise noted. By participating in this Contest, each participant understands that his/her personal information and other data provided in connection with the Contest will be collected and used in accordance with the HumanNation Studios Privacy Policy.
3. Selection of Five Grand Prize Winners:
On or about 9/19/09, five (5) winners (each a “Winner”) will be selected by Sponsor from among all eligible entries received on the basis of: (i) the extent to which the entrant’s appearance reflects the HumanNation brand (25%); (ii) the honesty and sincerity of entrant’s Entry Answers (25%); (iii) marketing potential of the entrant (25%); and (iv) the entrant’s audition performance/presentation/pitch (25%). The five (5) selected Winners will be the eligible entrants with the five highest cumulative scores based on the above criteria. In the event of a tie in determining a Winner, the entrant involved in the tie with the most creative Entry Answers will be selected as a Winner. Odds of being selected as one of the five (5) Winners will depend on the nature, quality, and number of eligible entries received. Selected Winners will be notified by phone and/or email on or about 9/19/09. Sponsor shall have no liability for any Winner notification that is lost, intercepted, or not received by a potential Winner for any reason. On or about 9/19/09, each successfully contacted Winner will be sent (via facsimile and/or other means determined in Sponsor’s sole discretion) an affidavit of eligibility together with liability/publicity release for such selected Winner (“Affidavit and Release”) which each selected Winner (and their parent & legal guardian if such Winner is under 18 years of age) must complete and return (as directed by Sponsor) in order to participate as a Winner. Each Winner’s participation may be recorded via video and/or audio recording. Such audio and/or video recordings may be disseminated/broadcast via web cast, DVD, and/or other media and each selected Winner may be required to complete and sign additional documents related to such broadcast/dissemination and satisfy other requirements. In Sponsor’s sole discretion, a selected Winner may be required to forfeit the opportunity to participate further in the Contest and an alternate Winner may be selected in accordance with the Official Rules from among the remaining eligible entries if such originally selected Winner (i) is unreachable; (ii) cannot (or does not want to) participate in the winner selection round for any reason; (iii) cannot accept, receive or use a prize for any reason; (iv) fails to comply with these Official Rules.
4. Prizes. Five (5) Grand Prize Winners; Seven (7) Runner-Ups
Five (5) Winners will each receive a $1500.00 Marketing contract from HumanNation Studios, which includes Marketing Services ranging from Photography, Image Branding, Graphic Design, Promotional Materials, and much more. (Printing & Publications not approved for Marketing Contract use) Prizes received are chosen at the Winner’s discretion to total $1,500.00 for Marketing & Promotional design & development services. ARV OF EACH WINNER PRIZE: $1,500.00. TOTAL ARV OF ALL PRIZES: $7,500.00 Prizes are subject to availability. Each Winner must be available on all date(s) and time(s) specified by Sponsor to claim prizes or available to reschedule to a date acceptable by Sponsor. Sponsor may substitute a prize (or a portion of a prize) with one of equal or greater retail value if prize (or portion of a prize) is unavailable or cannot be awarded for any reason. The value of the prizes set forth above represent Sponsor’s good faith determination of the ARVs thereof, and the actual fair market values, as ultimately determined by Sponsor, are final and binding and cannot be challenged or appealed.
Seven (7) Runner-Ups will receive $200.00 in Development Credit towards marketing services on future purchases at HumanNation Studios.
5. General Conditions.
By participating in this Contest, each entrant, (i) agrees to be bound by these Official Rules and the decisions of the judges, which are final and binding in all respects and cannot be appealed; and (ii) hereby release, discharges, indemnifies and holds harmless Sponsor and its employees, directors, affiliates, representatives and/or agents, against any and all liability, damages or claims, including, but not limited to, those associated with the infringement of any third party intellectual property rights, or arising in any way from entrants participation in the Contest or any Contest-related activity, included acceptance, possession or misuse of any prize or any printing, typographical, human, administrative or technological errors in or involving any materials associated with the Contest, including with limitation, property damage, personal injury or death. In giving this release, which includes claims that may be unknown at present, entrant acknowledges that she has read and understands Section 1542 of the California Civil Code, which reads as follows: ‘A general release does not extend to claims which the creditor does not know or suspect to exist in his favor at the time of executing the release, which if known by him must have materially affected his settlement with the debtor.” Each entrant expressly waives and relinquishes all rights and benefits under this section and any law of any jurisdiction of similar effect with respect to his/her release of any unknown or unsuspected claims he/she may have against Sponsor. THE CALIFORNIA COURTS (STATE AND FEDERAL) SHALL HAVE SOLE JURISDICTION OF ANY CONTROVERSIES REGARDING THE EVENT AND THE LAWS OF THE STATE OF CALIFORNIA (EXCLUSIVE OF CONFLICTS OF LAWS PROVSIONS) SHALL GOVERN THE EVENT. Each entrant grants to Sponsor, in perpetuity, any and all rights to any media, compositions, pictures, videos, and/or other content created by Sponsor in connection with the Contest and/or prize (collectively, the “Content”), and use and publication if entrant’s name and likeness in connection therewith, all without further consideration to entrant or any third party. Each entrant agrees that making the Content available to the public through Sponsor’s website(s), or any use by Sponsor for promotional or marketing activity related to the Contest is not a “sale or license”. Sponsor reserves the right, in it’s sole discretion, to modify, cancel or suspend this Contest (or any portion of the Contest) should an error or a virus, bug, computer problem or other cause or problem corrupt or inhibit the administration, security or proper operation of the Contest and in, such situation, to select the Winner from among the remaining eligible, non-suspect entries received prior to an/or after such action or in such manner as deemed fair and appropriate by Sponsor in it sole discretion.
